Adoptions

Adoptions are complex legal procedures, which may involve training courses, medical examinations, birth certificate modifications, or tax changes. Our attorneys will successfully see you through each step of the process with experience and confidence. Our attorneys have experience with both child and adult adoptions.

Child Support/Modification

You may be raising a child on your own, but both parents have a legal financial responsibility to care for their offspring. Our experienced attorneys help single parents file the appropriate documents and initiate or modify child support payments. When a person's income grows or shrinks their child support payments may change accordingly. Our attorneys help clients modify child support payments.

Dissolution of Marriage (Divorce)

Dissolution of marriage (divorce) is a complex process that involves many issues, including the distribution of property, assets (such as bank accounts, retirement accounts, etc.), and taxes. It also involves issues such as child custody/support/visitation and alimony.

A divorce can be contested and complex, or uncontested and simple. In some instances, a divorce may be uncontested, yet, still complex. More than 90% of divorces are resolved, through a settlement agreement, without ever going to court. This saves time and money for both parties. However, going to court is sometimes unavoidable.

In every case, attorneys at Mark C. Bouldin & associates, P.A. aggressively pursue their clients' interests through the entire process of settlement negotiations, mediation, alternative dispute resolution, and, if necessary, trial and appeal. After your divorce is resolved, our attorneys will continue working in your best interest to help you with post-marital estate planning to ensure continued financial protection of you and your loved ones.

Domestic Violence/Restraining Orders

We obtain, enforce, and dissolve domestic violence injunctions. As in all areas of practice, we act quickly to protect our clients' rights.

Paternity

The state of Florida encourages all fathers and mothers who aren’t married to file an affidavit acknowledging paternity. (This helps the child if one parent dies.). If the alleged father signs a voluntary acknowledgment of paternity, the courts don't have to decide parentage; but custody, visitation and child support often remain at issue.

If a father denies paternity, the parent who wishes to establish paternity must take the issue to court and has the burden of proving paternity. Unlike more conventional legal cases, contested paternity actions are decided primarily on the scientific evidence of DNA testing. The court will order such testing.

Although the courts typically decide paternity through scientific evidence, our attorneys can help clients maneuver through the court system and provide guidance in meeting their required burden of proof.

Prenuptial and Postnuptial Agreements

Marriage is a legal and emotional union. Unfortunately, Florida has one of the highest divorce rates in the country, consequently, every couple in the Sunshine State should consider a contract that defines and protects their partnership. There are two ways to accomplish this: Prenuptial and Postnuptial Agreements.

Prenuptial agreements are made before marriage and Postnuptial agreements are done anytime after marriage. Our attorneys prepare, review and enforce these agreements while minimizing confrontation by remaining mindful of the delicate emotional interests of the parties involved.

Support Enforcement/Contempt

Unfortunately, many people choose to ignore legal judgments against them. (Such as those who choose to flee to another state to avoid paying child support.) As a result, our attorneys frequently fight to successfully enforce court orders, which sometimes, requires holding the offenders in contempt until they meet their support obligations.
